A Massachusetts Subpoena Ad Testificandum, also called a Trial Subpoena, is a legal order that requires a person to appear and give live testimony. It is used when a witness is needed at a court hearing, trial, deposition, or agency proceeding. This type of subpoena does not ask for documents — it only requires the witness to show up and speak under oath.

In Massachusetts, a Notary Public has the authority to issue a Subpoena Ad Testificandum under Rule 45 and state law. Once the subpoena is properly issued and served, the witness must appear at the date, time, and location listed. Ignoring a subpoena can lead to court penalties or contempt.
